We provide our website and its contents on an "AS IS" basis and make no warranty or representation regarding any Product, either express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement, which are hereby expressly disclaimed, unless otherwise stated herein.

Errors on Our Website
Despite our efforts to ensure that the information on our website is accurate, complete and current, there may be instances when information about a Product contains inaccurate or incomplete data, including data about the Product's price or availability. We make no warranty or guarantee that the information on our website is complete, current or free of errors. We reserve the right to correct errors and/or update the content on our website at any time without notice. We also reserve the right to refuse or cancel any order containing any error or inaccuracy, including after the order has been submitted, whether or not the order has been confirmed and your credit card charged. If your order is canceled after your payment has been processed, we will issue a full refund to the original pay type.

Limitations and Exclusions
We reserve the right to change Product pricing, terms, specifications and warranties without notice. In addition, we may revise these terms of use at any time by updating the website. Online sales are intended for, and limited to, personal use and domestic sales only. We reserve the right to limit the number of Products sold, including the right to prohibit sales to re-sellers. Prices do not include shipping, tax or insurance. We disclaim all responsibility for the accuracy of any map or direction presented on our website.

If you are purchasing Products for export, you are responsible for the necessary export documentation before shipment is made to a foreign country. We will not ship to foreign locations. Warranties for exported Products may vary or be null and void.

Damages
In no event shall Home Poker Pros, its subsidiaries or affiliates, or their respective officers, directors, employees, representatives or agents be liable for special, incidental, consequential, punitive, indirect, or other special damages, including but not limited to, loss of data, use, or profits, however caused, whether for breach of contract, negligence, or otherwise, and whether or not we have been advised of the possibility of any such damages.

Payment Types We Accept Online
We accept the following forms of payment for your online purchases: Paypal, Visa, MasterCard, Discover and American Express. You may be able to redeem a Home Poker Pro gift certificate for online purchases. If you have trouble redeeming your gift certificate, please call or email our sales department. For your online purchases, you may purchase multiple products in a single order, and we'll accept one credit card and one certificate for each order. We are unable to accept cash, checks, C.O.D. orders and wire transfers for any website purchases. If you would like to make a purchase using either cash or a check, please call or email our sales department.

Sales Tax Policy
We do business throughout the United States and accordingly collect sales and use tax as required by applicable law. Your confirmation of your order total will reflect the applicable state and local sales tax, if any. The tax rate applied to your order will generally be the combined state and local rate for the address where your order was shipped, delivered or picked up.
For any online purchase of a tax-exempt item during a sales tax holiday period, by completing the purchase, you certify that the item is being purchased for personal use only and you agree to assume liability for the applicable tax if the item is used for other than personal use.

Order Fulfillment

Shipped Products
You may have your Product shipped via one of our available shipping options. We ship orders on normal business days, which are Monday through Friday excluding government holidays. Weekend shipment of orders is not currently available. For our Express Air service (i.e. next business day arrival), your order must be completed before 10 a.m. Pacific Time in order for it to ship the same day. Orders requesting our other shipping methods will ship within 3 business days from when the order was completed.
You assume all risk of loss for shipped Products. Order information such as billing or shipping address that is inaccurate or incomplete may result in delays. Products can not be shipped to incomplete addresses.
All shipping prices on this site are for domestic shipping only, within the continental U.S.A. For international shipping costs, please inquire by emailing Info@HomePokerPros.com.

Warehouse Pickup
To ensure we have your selected Products available for pickup at the warehouse, we have instituted certain authentication procedures.

At the time of pickup, you or an authorized user of the credit card used to make the purchase must present the store with a printout of your order confirmation screen (to be printed by you at time of purchase), the actual credit card used to make the purchase and a valid photo ID identifying the individual authorized to pick up the merchandise - either you as the purchaser or an authorized user of the credit card account – and matching our records for the online purchase. If a Gift Card was the sole payment method used to make the purchase, then you will be required to present a valid photo ID at the time of pickup, and the name on the ID must match the name on the order confirmation.

If you are unable to print the order confirmation screen at the time of purchase or have lost it prior to Product pickup, the individual picking up the Product must present a valid photo ID that matches our records and the information provided to make your purchase online. We reserve the right to withhold release of merchandise in circumstances where the documentation provided does not match applicable credit card information or the information provided at the time of purchase.

Product not picked up within 14 days of the order will be returned to inventory and a credit for the purchase amount will then be made to the credit card used to purchase the Product. If a gift certificate was the sole payment method used to make the online purchase, we will release the funds back to the gift certificate. We do not guarantee availability of the Product after it has been returned to inventory.

Order Cancellations
We are unable to refund any online purchase from the time your order is placed (when you click the Submit Order button) until your Product is received by you and returned to us. If you are not completely satisfied with your purchase after receiving your Product, please review our return policy to determine your preferred method of return.

Return Policy for Online Purchases
If you’re not completely satisfied with a product, Home Poker Pros will gladly exchange or refund the purchase within 20 days of the sale date, except as noted below.
Products are subject to a 15% restocking fee if returned opened or in a non-factory sealed box.
There is no restocking fee for defective product returned in exchange for the exact same product.
For any exchange or refund, we need the original receipt or a record of the purchase in our system, and the product must be in its original condition, including the box, UPC bar code, packaging, and all accessories.
Opened software or DVDs may be exchanged for the same title only.
Charges for services are nonrefundable after the services have been performed. Please contact our support department if you were not satisfied with any service, and we will evaluate the level of service provided on an individual basis. If any refund is awarded, it will be voluntary on our part, and be at the sole discretion of Home Poker Pros.

Autographed Memorabilia
Home Poker Pros certifies that any autographed memorabilia is authentic. If protective materials are tampered with on autographed memorabilia, it will not be accepted for return.

Missing Accessories
The value of missing items will be deducted from the credit amount of a return. For even exchanges, we will exchange what the customer returns (e.g., box for box, case for case, chip for chip, etc.)

Promotional Packages
Returns for promotional package items will only be accepted if all components of the promotional package are returned, and if replacement promotional packages are available. Individual package components may be exchanged if defective.

Incorrect Product
For any Product received that is not the Product ordered, we will exchange the item at no additional cost upon verification. Proof of purchase (e.g. order confirmation, packing slip or record of purchase in our system) is required for all returns. Please be sure to bring the credit card used for the purchase along with your proof of purchase for any warehouse returns. Warehouse returns must be set up in advance through the support department (support@homepokerpros.com)

Mail Returns
You may return any merchandise purchased online via mail provided that the return meets these guidelines.
Merchandise purchased online through homepokerpros.com (regardless of whether you picked it up at the warehouse or had it delivered to your home), which meets the Refunds and Returns guidelines above, may be returned via mail to our return address.

You will be responsible for all shipping and insurance charges for returns, unless otherwise indicated. If you choose not to insure your package, and we do not accept return of the Product, you will be responsible for any loss or damage. Upon our acceptance of the merchandise in like new condition in conformity with this policy, the purchase price will be credited to your credit card or a mail refund check will be issued for a purchase made with a gift card as the sole payment method. Allow 14 days (not including delivery time for mail refunds) from when we accept your returned Product for the processing of your credit. Additional charges may be assessed for Products returned with any missing items such as manuals and/or accessories. For Product that we verify to be defective, we will reimburse you for your original shipping expense on the Product that you return or exchange.

Governing Law
These terms are governed and construed by the laws of California without regard to its conflict of law rules. You agree that if any part of these terms is found to be unenforceable, the remainder of these terms will remain in full force and effect.

We realize that customers are concerned about how the information they provide online will be used. We are committed to protecting your privacy and will use the information we collect about you to process your order and promote Home Poker Pros products and services.
